SUPREME COURT OF NEW YORK, APPELLATE DIVISION, SECOND DEPARTMENT
July 8, 1968
IN THE MATTER OF ANTHONY PIAZZA ET AL., RESPONDENTS-APPELLANTS,
JOHN V. LINDSAY, AS MAYOR OF THE CITY OF NEW YORK, ET AL., APPELLANTS-RESPONDENTS
Christ, Acting P. J., Rabin, Benjamin, Munder and Martuscello, JJ., concur.
In our opinion, there is nothing in the plain language or legislative history of the pertinent provisions of the Charter which requires the Board of Estimate to hold a public hearing to consider site selection for a capital project after the Site Selection Board has held such a hearing and selected a site.
