Motion to dismiss an appeal from orders of the Appellate Division of the Supreme Court in the First Judicial Department, entered February 27, 1968, which unanimously (1) granted a motion to dismiss, for failure to timely prosecute, an appeal taken by plaintiff from a judgment of the Supreme Court, entered in Bronx County upon a decision of the court at a Special Term (Arthur Markewich, J.) dismissing the complaint after a trial, and (2) dismissed, as academic, a motion by plaintiff for leave to dispense with the printing or reproduction of certain exhibits.

Motion granted and appeal dismissed, without costs, upon the ground that an appeal does not lie as of right.
