Motion for leave to appeal from an order of the Appellate Division of the Supreme Court in the First Judicial Department, entered January 16, 1969, which denied a motion by defendant (1) to vacate a prior order of said court dismissing, for failure to prosecute, an appeal taken by him to said court from an order of the Supreme Court at Special Term (Margaret M. J. Mangan, J.), entered in New York County, adjudging him to be in contempt for failure to make payments for alimony, child support and counsel fees as required under a judgment of separation and (2) to restore said appeal to the calendar.

Motion dismissed upon the ground that the order sought to be appealed from does not finally determine the action within the meaning of the Constitution.
