ELMER LEWIS v. NIAGARA COUNTY BOARD ELECTIONS (06/19/69)

SUPREME COURT OF NEW YORK, APPELLATE DIVISION, FOURTH DEPARTMENT

June 19, 1969

ELMER LEWIS, RESPONDENT,
v.
NIAGARA COUNTY BOARD OF ELECTIONS, RESPONDENT, AND MICHAEL W. KISIEL, COMMISSIONER OF ELECTIONS, APPELLANT

Appeal from order of Niagara Special Term directing placing of name on ballot.

Del Vecchio, J. P., Witmer, Gabrielli, Bastow and Henry, JJ.

Memorandum: There is substantial merit to the contention of petitioner-respondent that an individual member of the Board of Elections has no authority to appeal from the order made herein. Without passing on this contention we conclude that the determination of Special Term was correct. (Order entered June 9, 1969.)

Disposition

 Order unanimously affirmed, without costs.
