PEOPLE STATE NEW YORK v. JOSEPH R. HEALEY (11/03/69)

SUPREME COURT OF NEW YORK, APPELLATE DIVISION, SECOND DEPARTMENT

November 3, 1969

THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT,
v.
JOSEPH R. HEALEY, APPELLANT

Order of the County Court, Dutchess County, dated December 19, 1968, affirmed.

Beldock, P. J., Christ, Brennan, Rabin and Hopkins, JJ., concur.

Appellant's contention that he was deprived of his right to appeal from the judgment of conviction by the conduct of his assigned counsel is conclusively refuted by the original papers which contain a timely notice of appeal from that judgment.
