National Labor Relations Board v. Local 282

UNITED STATES COURT OF APPEALS, SECOND CIRCUIT.

June 17, 1970

NATIONAL LABOR RELATIONS BOARD, PETITIONER
v.
LOCAL 282, INTERNATIONAL BROTHERHOOD OF TEAMSTERS, CHAUFFEURS, WAREHOUSEMEN AND HELPERS OF AMERICA, RESPONDENT.

Before WATERMAN, ANDERSON and SMITH, Circuit Judges.

Per Curiam: On May 18, 1970 (slip sheet 2901) when we found the Respondent to be in contempt in connection with its actions at the Howell construction site at Hofstra University, the Youngdahl construction site at Hofstra University, and the Sachem High School project, we referred the case to the Special Master to make recommendations to us as to the appropriate sanctions to be applied to the Union in each of those instances.

The Master having filed his recommendations, we approve the sanctions he has recommended and accordingly Order that the Respondent forthwith pay to the Clerk of the United States Court of Appeals for the Second Circuit the following sums of money:

For its contempt of this court in violating the court's injunction enjoining Local 282 from engaging in illegal secondary boycotts:

(1) For its violations at the Howell construction site at Hofstra University $15,000;

(2) For its violations at the Youngdahl construction site at Hofstra University $12,000; and

(3) For its violations in connection with the Sachem High School project $10,000.

And we further Order that upon the Respondent's failure to pay said sums of money within 30 days from the date of the filing of this order, we impose on the thirty first day an additional penalty of $15,000, and penalties of $500 per day thereafter until the full sums provided for in this order shall have been paid.
