 This case was referred to Magistrate Judge Leslie G. Foschio, pursuant to 28 U.S.C. § 636(b)(1), on February 5, 1997. On December 18, 1996, defendant filed a motion to suppress statements. On March 7, 1997, Magistrate Judge Foschio filed a Report and Recommendation recommending that defendant's motion to suppress be denied.

 This Court, having carefully reviewed Magistrate Judge Foschio's Report and Recommendation, and submissions of the parties, and no objections having been timely filed, it is hereby

 ORDERED, that pursuant to 28 U.S.C. § 636(b)(1), and for the reasons set forth in Magistrate Judge Foschio's Report and Recommendation, defendant's motion to suppress is denied.

 IT IS FURTHER ORDERED that the parties shall appear in Part II of this Court at 9:00 a.m. on April 8, 1997 for a meeting to set trial date.

 IT IS SO ORDERED.
