CONSTANTIS v. BANTIS

United States District Court, Southern District of New York

February 3, 2003

SAMUEL CONSTANTIS, PETITIONER,
v.
ARISTIDES BANTIS, RESPONDENT.

The opinion of the court was delivered by: Lewis A. Kaplan, United States District Judge

ORDER

Petitioner seeks confirmation of an NASD arbitration award pursuant to the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (the "FAA"). The application alleges that jurisdiction is invoked under Section 9 of the FAA.

The FAA does not confer subject matter jurisdiction on the district courts. Accordingly, the Court lacks jurisdiction and the proceeding therefore is dismissed. E.g., Dreyfus Service Corp. v. Gold, 02 Civ. 9415 (LAK), 2002 WL 31802347 (S.D.N.Y. Dec. 12, 2002).

SO ORDERED.
