IN THE MATTER OF ARBITRATION OF DISPUTES BETWEEN THE TRUSTEES OF THE AMALGAMATED COTTON GARMENT AND ALLIED INDUSTRIES FUND, PETITIONERS, AND ATESSA, INC., A/K/A ATTESA MANUFACTURING, RESPONDENT.

The Court having issued an Order, dated May 29, 2002, requiring Petitioner to file certificates attesting to the service of the original Petition to Confirm Arbitration Award and this Court's April 16, 2002 Preliminary Order, and Petitioner's counsel having responded to such order by providing copies of certificates attesting to certified and regular mail service of the Notice of Petition, Memorandum of Law and Petition to Confirm Arbitration Award and having failed to supply certification as to service of the Preliminary Order, and The Court having issued an Order, dated August 1, 2002, requiring Petitioner to comply fully with the Court's May 29, 2002 Order no later than August 23, 2002, and Petitioner having failed to respond to such order, it is hereby ORDERED, that this action is dismissed pursuant to Rule 41(b) of the Federal Rules of Civil Procedure for failure to comply with the orders of the Court.
