United States District Court, Southern District of New York

March 31, 2003

FMAC LOAN RECEIVABLE TRUST 1997-C, ET AL., PLAINTIFFS,
v.
MICHAEL L. STRAUSS, DEFENDANT.

The opinion of the court was delivered by: Lewis A. Kaplan, United States District Judge

ORDER

The complaint in this action purports to premise federal jurisdiction solely on diversity of citizenship. It fails adequately to allege the citizenship of either the defendant or of any of the business trust plaintiffs. Accordingly, absent the filing, on or before April 11, 2003, of an amended complaint sufficiently alleging complete diversity of citizenship, the action will be dismissed.

SO ORDERED.
