OPINION

Defendant Mosallem has filed a motion seeking the following relief:

(1) Dismissal of Count One;

(2) Striking from Counts Three, Four and Five the allegation that the scheme to defraud had, as one of its purposes, depriving another of the intangible right of honest services;
(3) A bill of particulars;

(4) Discovery of various materials.

The court denies the motion with respect to the first three of the above items. As to the discovery, the court is available to continue its discussions with counsel, already begun, regarding any information or materials which should be produced in advance of trial.
