United States District Court, Southern District of New York
April 18, 2003
LIGHTWATER CORPORATION LIMITED, PLAINTIFF, AGAINST THE REPUBLIC OF ARGENTINA, DEFENDANT. OLD CASTLE HOLDINGS, LTD., PLAINTIFF, AGAINST THE REPUBLIC OF ARGENTINA, DEFENDANT. MACROTECNIC INTERNATIONAL CORPORATION, PLAINTIFF, AGAINST THE REPUBLIC OF ARGENTINA, DEFENDANT.
The opinion of the court was delivered by: Thomas P. Griesa, United States District Judge
On April 14, 2003 the Court granted plaintiffs' motions for summary judgment and stated that judgments would be entered for the principal amounts of various bonds plus accrued interest. The Court stayed execution on these judgments for 30 days. That same day, counsel for plaintiffs Lightwater and Old Castle wrote requesting that the Court permit discovery as to the Republic's assets prior to the execution of judgments against the Republic. On April 17, 2003 the Republic wrote opposing this request.
The Court believes that discovery during the stay is not appropriate. To permit such discovery to go forward while execution is stayed would be premature. Plaintiffs' request is therefore denied.
