April 30, 2003

MILLENIUM FOR THE TRADE OF RAW MATERIALS AND MINERAL OILS, PLAINTIFF,
v.
ODIN MARINE, INC., DEFENDANT.

The opinion of the court was delivered by: Denise Cote, United States District Judge

OPINION

By order of the Part I Judge, this action was filed under seal on April 25, 2003. Under the terms of this previous Order, the action would be automatically unsealed on April 30, 2003, unless there was a further order from this Court. On April 30, 2003, plaintiff submitted a letter application on consent of the defendant to keep the action under seal. Accordingly, it is hereby

ORDERED that the plaintiff's application is denied except that it may file the verified complaint with the amount of the daily rate of hire, or those dollar figures from which a daily rate of hire could be calculated, redacted from the publicly filed complaint. This redacted version of the complaint will be entitled "Redacted Complaint."

IT IS FURTHER ORDERED that the unredacted complaint filed in this action shall remain sealed pending further order of this Court.

IT IS FURTHER ORDERED that a hearing shall be held on May 16, 2003 at 12:00 p.m. to determine whether the unredacted complaint shall be unsealed.

IT IS FURTHER ORDERED that the plaintiff shall serve a copy of this Order on all entities with an interest in the unsealing of the information related to the daily rate for hire.

SO ORDERED:
