ORDER

Plaintiff's motion for leave to serve and file a second amended complaint and for other relief is granted to the following extent:

1. Leave is granted. The second amended complaint is deemed served and filed as of this date. Defendants have ten days in which to answer or move with respect thereto.

2. The caption is amended to conform to that on the second am ended complaint, which is Exhibit J to plaintiff's motion.

3. Plaintiff, on or before May 20, 2003, shall serve and file a proposed discovery plan with respect to the claim newly added by the second amended complaint, showing in detail what discovery he proposes to conduct and why the discovery previously conducted was inadequate. Defendants may respond on or before June 6, 2003.

The motion is denied in all other respects.

SO ORDERED.
