QUINONEZ v. SACKMAN ENTERPRISES

United States District Court, Southern District of New York

May 27, 2003

ANDRES QUINONEZ, PLAINTIFF,
v.
SACKMAN ENTERPRISES, INC., DEFENDANT.

The opinion of the court was delivered by: Denise Cote, District Judge.

ORDER

On May 6, 2003, an Order was issued denying plaintiff's motion to amend his complaint to add Gallery Condominium as a defendant on the ground that Gallery Condominium does not employ the four employees required by the New York City Administrative Code ("Code"). The plaintiff has moved for reconsideration on the ground that the Code permits natural persons working as independent contractors to be counted as employees. This is not an argument that the plaintiff made in connection with the underlying motion. Because the plaintiff has not pointed to any argument or evidence that the Court overlooked in issuing the May 6 Order, it is hereby ORDERED that the plaintiff's motion to reconsider the May 6 ruling is denied.

SO ORDERED.
