KOMULAINEN v. MONTENAY POWER CORPORATION

United States District Court, Southern District of New York

May 30, 2003

DEAN KOMULAINEN, PLAINTIFF,
v.
MONTENAY POWER CORPORATION, ET AL., DEFENDANTS.

The opinion of the court was delivered by: Lewis A. Kaplan, District Judge.

ORDER

This is a personal injury case in which the plaintiff, a resident of Maine, allegedly was injured in a workplace accident that occurred in Islip, New York, which is in the Eastern District of New York. At a Rule 16 conference today, counsel were unable to identify any witness located in this district. To the contrary, all indications are that all potential witnesses in this case are located in Maine and on Long Island. Moreover, defendants and the third party defendant indicated that they have no objection to the case being transferred to the Eastern District.

In the circumstances, the parties are directed to show cause, on or before June 17, 2003, why this action should not be transferred to the Eastern District of New York pursuant to 28 U.S.C. § 1404(a).

SO ORDERED.
