ORDER

At the request of plaintiffs' counsel, the Court conducted a pretrial conference by telephone on September 10, 2003. In the course of the conference, the Court heard argument with respect to defendants' application to bifurcate the trial between liability and damages and, at plaintiffs' request, ruled on the matter during the conference. This order formalizes the ruling that liability will be tried first, with damages being reached only in the event of a verdict in favor of the remaining plaintiff as to liability.
