United States District Court, S.D. New York
January 27, 2004.
SHARON KORMENDI, Plaintiff -against- COMPUTER ASSOCIATES INTERNATIONAL, INC., Defendants
The opinion of the court was delivered by: LEWIS KAPLAN, District Judge
Defendants move, pursuant to Fed.R.Civ.P. 72, to set aside
portions of an order, dated October 21, 2003, by Magistrate Judge Douglas
Eaton, which directed that they make certain discovery.
A party challenging a magistrate judge's ruling on a matter such as
this must demonstrate the judge erred as a matter of law or that the
decision rests on a clearly erroneous factual determination. Defendants
have failed to do so. Accordingly, the motion is denied.
