PRETRIAL ORDER NO. 229
(Motions to Remand)
Plaintiffs in all of these actions have moved to remand. In five
reports and recommendations dated December 5, 2003, January 6,
2004 (two reports), January 8, 2004, and January 12, 2004
Magistrate Judges Katz and Gorenstein recommended that the motions be
denied. No objections have been filed. Accordingly, the motions all are
denied save that the motion in No. 03 Civ. 1345 is granted to the extent
that the claim against defendant The Medicine Shoppe Pharmacy is severed
and remanded to the court from which it was removed, all for
substantially the reasons set forth in the reports and recommendations.
