ORDER

On January 15, 2004 Magistrate Judge Roanne L. Mann issued a comprehensive, well-written, and well-reasoned Report and Recommendation ("R&R") recommending that the plaintiff's motion to amend his complaint be denied and that defendant Nevada State Bank's motion to dismiss be granted. The reason for these recommendations was that this court has no personal jurisdiction over defendant Nevada State Bank.

There have been no objections to the R & R. Therefore, the court reviews the R & R for clear error. Nelson v. Smith. 618 F. Supp. 1186 (S.D.N.Y. 1985). After careful review, the court finds no clear error in Magistrate Judge Mann's R&R and therefore adopts the R&R for the reasons stated therein. The plaintiff's motion to amend his complaint is hereby DENIED, and the defendant Nevada State Bank's motion to dismiss if hereby GRANTED.

  SO ORDERED.
