The opinion of the court was delivered by: THOMAS GRIESA, Senior District Judge
Plaintiff has submitted papers in which it requests the court to
order the issuance of a writ of execution and restraining notices in aid
of collecting on its judgment. It also requests the court to direct The
Republic of Argentina to show cause why certain procedures under state
law should not be allowed.
The court is not prepared to sign an order with the full set of
provisions requested by plaintiff. However, it is the view of the court
that plaintiff has made a showing that there are assets of The Republic
of Argentina, which may be subject to execution, and which are located at
Lehman Brothers Bank and BNP Paribas. In order to prevent the possible
movement of such assets while appropriate procedures are conducted by
this court, it is directed that plaintiff is permitted to serve
restraining notices on Lehman Brothers
Bank and BNP Paribas immediately pursuant to C.P.L.R. § 5222.
The court will hold a conference with counsel for both sides at 4:30
p.m., Tuesday, February 17.
