ORDER

On January 14, 2004, plaintiff Teamsters Local 408 Pension Fund in the above captioned Individual Action moved to voluntarily dismiss its complaint without prejudice pursuant to Rule 41, Fed.R. Civ. P., on the condition that it be permitted to remain a member of the class for all claims asserted in the class action. For the reasons stated in the Opinion and Order of January 26, 2004, it is hereby

ORDERED that pursuant to this Court's January 26 Order, plaintiff Teamsters Local 408 Pension Fund's motion to dismiss Page 2 its complaint voluntarily on the condition that it participate in the WorldCom consolidated class action is granted.
