IN RE WORLDCOM, INC. SECURITIES MASTER FILE LITIGATION
The opinion of the court was delivered by: DENISE COTE, District Judge
On February 20, 2004, the Court dismissed the complaint in Bell,
et al. v. Ebbers, et al., 03 Civ. 4490 on the ground that this
action was preempted by the Securities Litigation Uniform Standards Act,
Pub.L. No. 105-353, 112 Stat. 3227 (1998) ("SLUSA"). On February 20,
this Court issued a Scheduling Order requesting any motion to dismiss the
other nine actions filed in Mississippi Circuit Court (the "Nine
Actions") based on the holdings of the February 20 Opinion be filed by
February 27. On February 23, this Court received Motions for Leae to File
Amended Complaints dated February 21 submitted by plaintiffs in 03 Civ.
4490 (the "Bell Plaintiffs") and in the Nine Actions. In addition, on
February 23, the Court received the Bell Plaintiffs' Motion for
Reconsideration of the February 20 Opinion. It is hereby
ORDERED that the February 20 Scheduling Order is vacated.
IT IS FURTHER ORDERED that the schedule below will govern the briefing
of any motions to dismiss the above-captioned matters as well as the
motions filed by the Bell Plaintiffs and the plaintiffs in the
Nine Actions. By the following dates, the parties shall submit:
February 27 Any motion to dismiss the Nine Actions.
March 5 Defendants' opposition to the Motions for Leave to
Amend and the Motion for Reconsideration.
March 19 Plaintiffs' opposition to any motion to dismiss.
March 19 Plaintiffs' reply on their Motion for Leave to Amend
and on the Motion for Reconsideration.
March 26 Defendants' reply on their motion to dismiss.
