ORDER

Various disputes among the parties in the Securities Litigation have been the subject of recent letters to the Court. Conferences will be held on March 9, 2004, beginning at 9:30 a.m. to address these disputes. At present, the following issues will be addressed on March 9.

• The discovery dispute with third-party KPMG LLP.

  • The motion to remand and bankruptcy stay in Reynolds v. Alien, No. 03 Civ. 9822.

  • The timely production of Underwriter Defendant e-mails.•

  • The identification of due diligence documents by the Underwriter Defendants.

  • The confidentiality designations of documents produced in this litigation pursuant to the October 24, 2003 Stipulation and Agreed Confidentiality Order.

  • The proposed plan for deposition discovery of plaintiffs in the Individual Actions. Page 2

  A schedule listing the order in which these disputes will be addressed will be issued before March 9.
