The opinion of the court was delivered by: DENISE COTE, District Judge
On December 12, 2003, this Court issued an Order Regarding
Dissemination of Notice of Class Action (the "December 12 Order") which,
among other things, stated that Lead Counsel and the Notice Administrator
should file a Declaration with the Court on March 1, 2004, ten days after
the February 20, 2004 opt out deadline. The Declaration is to describe
the actions taken with respect to the December 12 Order and identify the
persons who requested exclusion from the Class in accordance with Section
VI of the Class Notice.
In light of the extension of the opt out deadline, Lead Counsel
requests that the time for filing the Declaration pursuant to the
December 12 Order be extended so that the Declaration is not required
until ten days after the date that is eventually set as the deadline for
exclusion requests. It is hereby
ORDERED that the time for filing the Declaration described
in the December 12 Order is extended until ten days after the close
of the opt out period.
