ORDER

The Court will hear argument on the cross-motions for summary judgment on March 24, 2004, at 10:00 a.m. The parties should be prepared to address, among other things, the following questions:

1. Are Count One, which is the subject of the cross-motions, and Count Three of the defendant's counterclaims moot?

  2. What is the status of the arbitration that was scheduled to commence on July 7, 2003?

  3. What information, if any, concerning the QuesTec Umpire Information System was sought by or provided to the World Umpires Association during or in connection with the arbitration or otherwise subsequent to the briefing of the motions?

  The parties shall file any written submissions with respect to these questions by 1:00 p.m. on March 23, 2004.
