U.S. v. DIPIETRO

United States District Court, S.D. New York

March 17, 2004.

UNITED STATES OF AMERICA, -against- ANGELO DIPIETRO ET. AL., Defendant

The opinion of the court was delivered by: SHIRLEY KRAM, Senior District Judge

OPINION & ORDER TO BE FILED UNDER SEAL
In an opinion dated March 2, 2004, the Court, based on a careful and thorough review of the submissions of both parties, and in accordance with the jurisprudence of the U.S. Supreme Court and the Second Circuit, disqualified the Law Offices of Gary Greenwald, Esq. from representing Defendant Angelo DiPietro in this matter. Six days after being disqualified, defense counsel submitted a letter to the Court requesting that it reconsider its decision. See Gary Greenwald Letter, dated March 8, 2004 ("Def. Ltr."). While defense counsel's letter does contain a litany of blistering accusations against the Court and its practices,*fn1 Page 2 it does not provide any basis, in either fact or law, to depart from the Court's March 2, 2004 decision disqualifying Gary Greenwald from representing Angelo DiPietro. Accordingly, the motion to reconsider is denied.

SO ORDERED.
