SCOTT v. MULLER

United States District Court, S.D. New York

March 31, 2004.

ALLEN ROGERS SCOTT, Plaintiff, -against- DOCTOR MULLER, et al., Defendants

The opinion of the court was delivered by: LEWIS KAPLAN, District Judge

ORDER

This case was dismissed in 2000, and plaintiffs appeal from the dismissal itself was dismissed by the Court of Appeals in 2001.

Plaintiff, proceeding pro se, has submitted a largely incomprehensible handwritten paper, the body of which contains the following:

MOTION TO RENEWAL AND REOPEN CASE S.D.N.Y. 96-CV-1 111 Kaplan, J., Dolinger Mag. J. [NEW MEDICAL EVIDENCE] United States Court of Appeals for the Second Circuit
Present Hon: James L. Oakes; Chester J. Strauds [sic] Circuit Judges; Jed S. Rakoff District Court Judge
There is no caption.

It is impossible to tell from the document submitted whether plaintiff intends to move in the Court of Appeals or in this Court. If and to the extent he intends the latter, the motion is denied, as no basis for relief from the judgment has been shown.

  SO ORDERED.
