OPINION AND ORDER

Plaintiff in the above-captioned action moved this court on March 30, 2004, for appointment of counsel. However, by Order dated April 2, 2004, the plaintiff's case was dismissed for failure to exhaust remedies as required by the Prison Litigation Reform Act ("PLRA"), 42 U.S.C. ยง 1997e(a). Accordingly, his motion for appointment of counsel is denied as moot. The Clerk of the Court is respectfully directed to mark this motion closed.
