ORDER AND FINAL JUDGMENT
In the United States District Court for the Northern District of
Mississippi; Greenville Division;
THIS CAUSE came on to be heard upon the ore tenus motion of the
Plaintiff, Brent Collins Wong, who moves this Court to dismiss with
prejudice his claims against the Defendant, Barry Gillespie, M.D., and for
an Order of this Court expunging from the records of the United States
District Court, Southern District of New York the name of Barry
Gillespie, M.D. as a Defendant in the above styled and numbered civil
action and the entry of a final judgment as to said Defendant. The
Court, having considered the motion, noting the agreement of counsel for
Plaintiff, Brent Collins Wong, and the Defendant, Barry Gillespie, M.D.,
and being otherwise fully advised in the premises, finds that the motion
is well taken and should be granted.
IT IS, THEREFORE, ORDERED AND ADJUDGED that the Complaint and all
claims filed therein by the Plaintiff, Brent Collins Wong, against the
Defendant, Barry Gillespie, M.D., shall be and hereby are dismissed with
IT IS FURTHER ORDERED AND ADJUDGED that all other claims of the
remaining Plaintiffs against the other Defendants named in this civil
action are hereby reserved as stated in the Complaint and will proceed
accordingly. ORDERED AND ADJUDGED, this the 28 day of April 2004.
