The opinion of the court was delivered by: DENISE COTE, District Judge
On May 4, 2004, the Underwriter Defendants requested an extension of
the time provided in the Court's May 3, 2004 Order in which to notify
Lead Plaintiff that they do not intend to rely on the advice of counsel
defense. For the reasons stated on the record at a telephone conference
held on May 4, it is hereby
ORDERED that the Underwriter Defendants' request is granted.
IT IS FURTHER ORDERED that the Underwriter Defendants and SSB
Defendants have until May 7, at 5:00 p.m. to inform Lead Plaintiff in
writing, explicitly and unambiguously, that they do not intend to rely on
the advice of counsel defense.
IT IS FURTHER ORDERED that in the event such notice is not given, Lead
Plaintiff may redepose any witness who failed on April 30, or May 3
through May 7, to respond completely to the questions permitted by the
Court's May 3 Order. Such additional deposition time shall not be
deducted from the time the plaintiffs in the Securities
Litigation have been allotted for depositions.
