ORDER

On May 7, 2004, the following plaintiffs in the above-captioned Individual Action moved to voluntarily dismiss their claims without prejudice pursuant to Rule 41, Fed.R. Civ. P., on the condition that they be permitted to remain members of the class for all claims asserted in the class action: the Maintenance Employees Teamsters Local 416 Pension Fund, Plumbers & Steamfitters Local 577 Pension Fund, Pension Fund of Local 227, Operative Plasterers and Cement Masons Local 109 Pension Fund, UFCW Local Unions and Employers Pension Plan of Southwestern Ohio Area, Plumbers and Pipefitters Local 219 Pension Fund, Sheet Metal Workers Local Pension Fund, and IBEW Local 246 Pension Fund. For the reasons stated in the Opinion of January 26, 2004, and pursuant to Orders of January 26 and April 12, 2004, it is hereby ORDERED that plaintiffs' motion to dismiss their claims voluntarily on the condition that they participate in the WorldCom consolidated class action is granted.

IT IS FURTHER ORDERED that all plaintiffs in this action having moved to dismiss their claims, the Clerk of Court shall dismiss the action with prejudice and close the case.
