ORDER

At a conference on May 7, 2004, the defendants in the Securities Litigation were ordered to identify by May 21 how much time they wish to reserve to depose the thirteen "embargoed" witnesses and Bernard J. Ebbers in the event Ebbers enters a plea of guilty, and in the event he proceeds to trial on the criminal charges pending against him. An Order of May 12 granted with certain exceptions the joint application by Lead Plaintiff and the Citigroup Defendants for a three-week suspension of all discovery-related proceedings. In order to clarify a potential source of confusion, it is hereby

ORDERED that the three-week suspension does not apply to the non-Citigroup Defendants' obligation to identify by May 21 how much time they wish to reserve for the depositions of embargoed witnesses and Ebbers.
