ORDER

On April 8, 2004, Defendants filed a motion for partial summary judgment on behalf of Defendants City of Syracuse and Officer Christopher Lundborg. See Dkt. No. 40. When the Court did not receive any submissions from Plaintiff, it contacted Plaintiffs attorney to determine the status of the motion. In response, Plaintiffs attorney wrote to the Court, stating that Plaintiff did not plan to oppose the motion. Accordingly, there being no opposition to Defendants' motion for summary judgment with respect to the claims asserted against Defendants City of Syracuse and Officer Lundborg, the Court hereby

  ORDERS that Defendants' motion for summary judgment with respect to the claims against Defendants City of Syracuse and Officer Lundborg is GRANTED.

  IT IS SO ORDERED.
