ORDER

On May 18, 2004, plaintiffs in the above captioned Individual Action — United Food and Commercial Workers Union Local 880-Retail Food Employers Joint Pension Fund, United Food and Commercial Workers Union Local 880-Mercantile Employers Joint Pension Fund, United Food and Commercial Workers Union-Employer Pension Fund, and United Food and Commercial Workers Union-Employer Health and Welfare Fund — moved to voluntarily dismiss their complaint without prejudice pursuant to Rule 41, Fed.R. Civ. P., on the condition that they be permitted to remain members of the class for all claims asserted in the consolidated class action. For the reasons stated in the Opinion of January 26, 2004, and pursuant to Orders of January 26 and April 12, 2004, it is hereby ORDERED that the motion by the plaintiffs to dismiss their complaint voluntarily on the condition that they participate in the WorldCom consolidated class action is granted.

IT IS FURTHER ORDERED that all plaintiffs in this action having moved to dismiss their claims, the Clerk of Court shall dismiss the action with prejudice and close the case.
