ORDER

Having reviewed the parties' submissions of May 21, 2004 regarding their requested reservation of time to depose thirteen presently embargoed witnesses and defendant Bernard J. Ebbers ("Ebbers"), it is hereby

ORDERED that defendants in the Securities Litigation may reserve up to twelve days to depose these witnesses in the event they are available to be deposed prior to the class action trial in the Securities Litigation.

  IT IS FURTHER ORDERED that the plaintiffs in the Securities and Erisa Litigations may reserve up to 8 days to depose any such witness in the event the defendants choose not to proceed with one or more of the depositions. IT IS FURTHER ORDERED that, in deciding how to use the remainder of their allotted time, the parties should make those decisions without regard to whether any deposition of the embargoed witnesses or Ebbers will occur.

  SO ORDERED.
