ORDER

Having considered the letters of June 10 and 11, 2004 regarding the desire of the Underwriter Defendants to depose H. Carl McCall and Alan Hevesi, it is hereby

ORDERED that the defendants in the Securities Litigation may depose each witness at the New York office of counsel for the Underwriter Defendants.

  IT IS FURTHER ORDERED that all questioning by counsel for defendants in the Securities Litigation may last for no more than two hours per witness in the event that the defendants choose to depose both witnesses.

  IT IS FURTHER ORDERED that in the event that defendants do not choose to depose Mr. McCall, the total time allotted for questioning of Mr. Hevesi by counsel for the defendants in the Securities Litigation shall be no more than four hours.

  SO ORDERED.
