LEWIS v. NISSAN NORTH AMERICA

United States District Court, S.D. New York

July 6, 2004.

REGINA LEWIS, Plaintiff,
v.
NISSAN NORTH AMERICA, INC., CORP., et al., Defendants.

The opinion of the court was delivered by: LEWIS KAPLAN, District Judge

ORDER

Defendants' motion to for a more definite statement and other relief [docket item 6] was referred to Magistrate Judge Katz, who rendered a combined memorandum opinion and order and report and recommendation, dated June 8, 2004. Judge Katz there disposed of those aspects of the motion that were within his power to rule upon, but recommended that this Court dismiss plaintiff's claims under 42 U.S.C. § 1983, 1985 and 1986, pursuant to 28 U.S.C. § 1915(e)(2)(B), on the ground that they are frivolous and fail to state a claim upon which relief may be granted. The Court hereby accepts that recommendation and dismisses those claims for the reasons set forth in the report and recommendation, no objection to which has been filed.

SO ORDERED.
