Having received unopposed requests from counsel to Merrill Lynch Trust Company FSB ("Merrill Lynch") to: (1) allow the deposition of Rene Campis ("Campis"), originally scheduled to take place on July 14, to occur after July 23, the date fact discovery closes in the ERISA Litigation; and (2) extend the summary judgment schedule in the ERISA Litigation set forth in the June 14, 2004 Order, it is hereby

ORDERED that the Campis deposition may be rescheduled for after July 23.

  IT IS FURTHER ORDERED that any summary judgment motion is to be submitted by September 13, 2004. Opposition is due October 12; any reply is due October 25.
