ORDER

Plaintiff brought this proceeding to confirm in part and vacate in part an arbitration award. The proceeding was commenced on April 14, 2004.

By order dated June 14, 2004, the Court notified plaintiff that the proceeding would be dismissed absent the filing, on or before the 120th day after commencement of the matter, of proof of due service. The 120-day time period no having elapsed and no proof of service having been filed, the proceeding is dismissed pursuant to Fed.R.Civ.P. 4(m).
