ORDER

Plaintiff seeks, pursuant to Fed.R.Civ.P. 72, to vacate and set aside Magistrate Judge Peck's July 20, 2004 order, which denied plaintiff's request for an extension of time within which to respond to defendants' motion to dismiss. The Court treats the application as an appeal from the order.

The procedural order of a magistrate judge will be set aside only if it is clearly erroneous or contrary to law. See 28 U.S.C. ยง 636(b)(1)(A); Fed.R.Civ.P. 72(a). Plaintiff has shown no error of law, and the order is not clearly erroneous.
