On July 22, 2004, this Court received plaintiff's renewed
motion to remand On May 11, 2004, the United States Court of
Appeals for the Second Circuit affirmed this Court's denial of a
motion to remand in a related action. On July 23, 2004, the
Second Circuit denied the petition for rehearing and for
rehearing en banc. It is hereby
ORDERED that plaintiff's motion to remand in No. 04 Civ. 4963
(DLC), is denied for the reasons set forth in this Court's
Opinions dated March 3, May 5, and May 20, 2003, and the May 11
decision by the Second Circuit. The Court declines to abstain or
to remand on equitable grounds for the reasons set forth in the
Opinion of March 3, 2003.
