The opinion of the court was delivered by: DENISE COTE, District Judge
By letter of August 9, 2004, all the Director Defendants with
the exception of Bert C. Roberts, Jr. ("Roberts") namely, Carl
J. Aycock, John Porter, Clifford Alexander, James C. Allen,
Judith Areen, Max E. Bobbitt, Francesco Galesi, Stiles A.
Kellett, Jr., Gordon S. Macklin, Lawrence Tucker, and the Estate
of John W. Sigmore requested an adjournment from August 20 to
September 10, 2004 to file any motion for summary judgment and
disclose expert reports in the Securities Litigation. Lead
Plaintiff has no objection to the requested adjournment. Counsel
for the Underwriter Defendants, SSB Defendants, Arthur Andersen,
LLP and Roberts have taken no position with respect to this
application. It is hereby
ORDERED that the Director Defendants, with the exception of
Roberts, have until September 10, 2004 to submit their summary
judgment motions. Any opposition to these motions are due October
1; any reply is to be submitted by October 8.
IT IS FURTHER ORDERED that the Director Defendants, with the
exception of Roberts, have until September 10, 2004 to disclose
their expert reports. IT IS FURTHER ORDERED that this Order does not affect the
August 20 expert disclosure and summary judgment filing deadline
for any other party to the Securities Litigation.
