PARTIAL DEFAULT JUDGMENT

THIS ACTION having been commenced against defendant Felicia Davis ("defendant") by the filing of the Second Amended Complaint of the United States on July 8, 2004, and service on defendant on July 23 and 26, 2004, pursuant to Fed.R. Civ. P. 4(e); the United States having caused Proof of Service of the Second Amended Complaint to be filed on September 8, 2004; defendant not having appeared, answered or made any motion with respect to the Second Amended Complaint; the time for defendant to appear, answer or make any motion with respect to the Second Amended Complaint having expired; the Clerk of this Court having duly entered a certificate of entry of default of defendant; sufficient proof having been adduced that defendant is not in the military service of the United States and is not an infant or incompetent person, NOW, on the motion of David N. Kelley, United States Attorney for the Southern District of New York, attorney for plaintiff, it is hereby

  ORDERED AND ADJUDGED that Judgment be entered against Felicia Davis dismissing her with prejudice as a party to this action; and it is further

  ORDERED AND ADJUDGED that Felicia Davis has no claim or interest in the subject matter of this interpleader action, namely, a Fancy Intense Yellow Diamond Ring of 83.48 carats and a 6.56 carat Yellow Diamond ring; and it is further

  ORDERED AND ADJUDGED that there being no just cause for delay, the Clerk of this Court is directed to enter judgment forthwith, without costs or fees to either plaintiff or defendant Felicia Davis.
