STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE

IT IS HEREBY STIPULATED AND AGREED THAT:

  1. All claims by plaintiffs Mary Martha Franklin, Carol Elliot (on behalf of the estate of Rosemary Simpson) and Kevin Farmer are dismissed with prejudice as to all defendants in this action.

  2. There are no motions pending in these matters. When approved, this Stipulation of Dismissal will close these cases in their entirety.

  3. Each party shall bear its own costs and attorneys' fees. SO ORDERED.
