PRETRIAL ORDER NO. 331 (Motion to Dismiss and to Strike)

The motion of the plaintiffs in 01 Civ. 7767 to dismiss Warner Lambert's July 30, 2004 motion for summary judgment as to them [00 Civ. 2843, DI 2409] is denied. The plaintiffs are mistaken; their civil action number does not appear in the caption of the defendants' motion. The plaintiffs may have misread the designation of 02 Civ. 7767, which does appear in that caption, as a reference to their own action.

The Court admonishes counsel to use more care before consuming the Court's attention with unnecessary motions.
