December 8, 2004.

In re: REZULIN PRODUCTS LIABILITY LITIGATION (MDL No. 1348). This Document Relates to: 01 Civ. 8343, 03 Civ. 8928.

The opinion of the court was delivered by: LEWIS KAPLAN, District Judge

PRETRIAL ORDER NO. 330 (Motion for Extension of Time, Motion to Dismiss of John Peter Louwerens, M.D.)
The following motions are disposed of as follows:
1. Plaintiff Joyce Anderson's motion for an extension of time [00 Civ. 2843, DI 2559] is denied as moot. Counsel apparently filed to submit courtesy copies as required by the undersigned's individual practices, which resulted in the Court's not learning of the motion until after it became moot.

2. The motion to dismiss of John Peter Louwerens, M.D. in 03 Civ. 8928 (Adams) [00 Civ. 2843, DI 2460], which is unopposed, is granted as necessarily decided by PTO 283 dated June 3, 2004.

  SO ORDERED.
