IN RE: REZULIN PRODUCTS LIABILITY LITIGATION

United States District Court, S.D. New York

July 13, 2005.

In re: REZULIN PRODUCTS LIABILITY LITIGATION (MDL No. 1348). This Document Relates to: 01 Civ. 0974, 01 Civ. 7765.

The opinion of the court was delivered by: LEWIS KAPLAN, District Judge

PRETRIAL ORDER NO. 389 (Motion for Extension of Time)

Plaintiff's counsel moves for a 90-day extension of the August 1, 2005 deadline set by PTO 370 for submission of expert reports for plaintiffs whose surnames begin with the letters A through I, arguing that his files are in storage as a result of counsel's change in law firms on June 1, 2005 and his inability to meet with his expert.

In view of PTOs 387 and 388, counsel now represents only one plaintiff in these actions, Ms. Crutchfield. The Court seeks no reason why 90 days is necessary to prepare the requisite expert report with respect to one plaintiff. Accordingly, the motion is granted, but only to the extent that the report shall be served no later than August 13, 2005.

  SO ORDERED.
