In an Opinion and Order issued today, BNY's motions for summary
judgment to obtain indemnification and to dismiss NCL's
indemnification claim were granted, and NCL's cross-motion was
denied. Therefore, it is hereby ORDERED that BNY shall serve its calculation of its reasonable
attorneys' fees and costs incurred during this litigation by
August 22, 2005, with any necessary supporting documents, and
that NCL shall serve its objections, if any, to such fees and
costs by August 29, 2005.
IT IS FURTHER ORDERED that the parties shall inform the Court
by September 9, 2005 if any dispute regarding the amount owed to
BNY continues to exist, and submit proposed orders for an award
of attorneys' fees and expenses.
