IN RE WORLDCOM

United States District Court, S.D. New York

August 19, 2005.

In re WorldCom, Inc. Securities Litigation, This Document Relates to: Johnston
v.
Salomon Smith Barney, Inc, et al., No. 04 Civ. 7980 (DLC).

The opinion of the court was delivered by: DENISE COTE, District Judge

Dear Judge Cote:

We represent the Underwriter-Related Defendants in the above action and write to seek an enlargement of the Court's 25 page limit for memoranda of law. We seek an additional 5 pages for the Underwriter-Related Defendants' Memorandum of Law in Support of Their Motion to Dismiss. In preparing the motion to dismiss, we have determined that to properly address the issues raised by the complaint the Underwriter-Related Defendants will require no more than 30 pages. However, we will strive to use less than that if possible. Accordingly, we respectfully request that this Court permit a 5 page enlargement for the aforementioned memorandum of law.
